Kemulate is a software, marketplace, supplier directory, partner ecosystem, education, consulting, compliance, manufacturing, formulation, advertising, networking, and business management platform serving the cosmetic, beauty, personal care, wellness, household product, and related industries. This Privacy Policy describes how Kemulate collects, uses, and shares information across our software, marketplace, supplier directory, partner ecosystem, education, advertising, and related services.

Scope

This policy covers user accounts, formulas, documents, supplier data, marketplace interactions, analytics, advertising, educational services, partner programs, and any other Kemulate service now or in the future.

Information We Collect

Account details (name, email, organization); content you upload (formulas, documents, records); usage and device data; communications; payment and billing data processed by our payment providers.

How We Use Information

To provide and improve the platform; to operate marketplaces and the supplier directory; to deliver advertising and partner features; to provide education and support; to comply with law; and to secure the service.

Sharing

We share information with service providers under contract (hosting, analytics, payments); with partners you choose to interact with; and as required by law. We do not sell personal information.

Your Rights

Subject to applicable law, you may access, correct, export, or delete personal data. Contact us to make a request.

AI Processing & Ask KI™

When you use Ask KI™ (Kemulate Intelligence) or any other AI-assisted feature, relevant workspace data — which may include formulas, ingredients, quality records, inventory data, and other content you submit — may be transmitted to and processed by third-party AI providers under contract with Kemulate to generate the requested analysis. AI providers may change over time. Kemulate may retain Ask KI inputs, outputs, credit transactions, and interaction history for quality improvement, abuse prevention, billing reconciliation, and support purposes. Do not submit sensitive data through Ask KI that you do not have the right to process under this Privacy Policy. See the AI Disclaimer and Terms of Service for additional limits on AI features.

Retention

We retain information for as long as needed to provide the service, comply with legal obligations, resolve disputes, and enforce agreements. Deleted data may not be recoverable.

Aggregated, Anonymized & Non-Identifiable Data

Kemulate may collect, aggregate, anonymize, and de-identify platform data and use it for industry benchmarking, analytics, product development, market research, intelligence products, reports and insights, commercial data products, and current and future Kemulate offerings. Such aggregated, anonymized, and non-identifiable information may be used across Kemulate, KosIndex™, KosFlux™, KosGlamorate™, and other current or future Kemulate-branded or affiliated products and services, as well as Kemulate's affiliated entities, subsidiaries, parents, and successors in interest. Kemulate may use aggregated, anonymized, statistical, benchmark, trend, operational, and intelligence data to develop, improve, market, commercialize, license, distribute, and support products and services offered by Kemulate™, KosIndex™, KosFlux™, KosGlamorate™, affiliated entities, subsidiaries, successors, partners, future products, and future business ventures. Such usage may include industry reports, benchmarks, market intelligence, pricing insights, supplier insights, ingredient trends, manufacturing trends, forecasting tools, and other commercial data products. For avoidance of doubt, proprietary formulas, formula percentages, manufacturing processes, trade secrets, confidential workspace documents, customer lists, supplier contracts, and other confidential business information are not included in such usage in identifiable form and will not be intentionally disclosed, sold, licensed, or published except as authorized by the customer, required by law, or as otherwise described in these policies. The following categories are NOT included in such usage and will not be intentionally sold, published, licensed, syndicated, or made accessible to other users or third parties in identifiable form: formulas; formula percentages; manufacturing processes; batch records; trade secrets; customer lists; supplier contracts and pricing terms; proprietary business records; and confidential workspace documents. Kemulate may only use data in aggregated, anonymized, or otherwise non-identifiable form — meaning data that cannot reasonably be used, alone or in combination with other available information, to identify a specific company, brand, formula, product, manufacturing process, customer, supplier, or user. Successors, Affiliates & Business Transfers

Our rights and obligations under these Terms and this Privacy Policy may be assigned or transferred, in whole or in part, in connection with a merger, acquisition, financing, reorganization, joint venture, asset sale, change of control, sale of all or substantially all of Kemulate's business or assets, or any similar transaction, including to affiliated entities, subsidiaries, parents, and successor entities. In any such transaction, your information and the protections set out in these documents will travel with the relevant business or assets, and the receiving party will be bound by the same confidentiality, de-identification, and use restrictions.
